Shepherds Huts - Underscar Manor« Back to Questions List

I understand that a planning application has been made for a number of Shepherds Huts by Underscar Manor. Anyone know anything further?

It would appear that the planning application was withdrawn 31st March 2022, presumably due to all the objections that had been lodged?

Do the committee know if the walk referred to in these objections has been reopened for timeshare owners to use.?

The following was quoted in a couple of the objections….
“ will the public footpath from the Gale Road to Ormathwaite be re-opened? I do not know the precise legal status of the path but my understanding is that it is a public right-of-way. Certainly it was used regularly by local people and visitors. ”
“ Since childhood I have walked the area and until Underscar Manor was purchased by the current owner, a favourite walk was from here, via Applethwaite, across two fields to Ormathwaite and up the footpath through the natural deciduous woods to the south of Underscar Manor and the more recent Timeshare Properties, to Gale Road. Thence up to Latrigg and Skiddaw. The path was enhanced and upgraded by the previous owners, so that we, and the Timeshare owners could enjoy the woodland.
…..When the current owner shut off the footpath – supposedly for safety reasons, when building the biomass building – we were assured that the closure was temporary. That was years ago! Since then, an application for a winery, more than doubling the size of the existing biomass building, has been approved, and the footpath remains closed to local residents.”

So the question remains was this classed as a public right of way and has the footpath been reopened?

If not, do the Committee have plans to try and reestablish this right of way, or is this not considered part of their current remit?
N.B Would this require checking with the Highway authority that the footpath in question is classified as a public right of way and is shown in the definitive map held by the highway authority?

Prodigal Son Ltd has made a Planning Application to the Lake District National Park planning authority for the installation of 6 shepherds huts (holiday accommodation) as farm diversification. The application can be viewed on the Lake District Planning web site under application number 7/2021/2213
